Improper service, intimidating behaviour, abuse of power during a seizure, disproportionate billing — the Office of the Syndic of the Chambre des huissiers de justice du Québec receives complaints against bailiffs, free of charge.
The Office of the Syndic of the Chambre des huissiers
Did a bailiff treat you in an intimidating manner during a seizure? Was a service of documents carried out improperly? Did you receive a disproportionate fee invoice? The Office of the Syndic of the Chambre des huissiers de justice du Québec (CHJQ) is the independent body responsible for investigating the conduct of bailiffs and protecting the public.
This guide shows you how to organize your facts, draft your investigation request with the help of AI, and submit it directly to the Syndic — in three simple steps.
When to file a complaint — the most common grounds
The vast majority of bailiffs carry out their duties professionally. But when this is not the case, several concrete situations can justify an investigation request to the Office of the Syndic.
| Ground | Description |
|---|---|
| Improper service | Failure to comply with the rules of the Code of Civil Procedure: documents delivered to the wrong person, no minutes drawn up, non-compliant method of service, sale notice improperly published. |
| Abusive or intimidating behaviour | Intimidation, threats, inappropriate remarks, aggressive tone during a seizure or eviction, failure to identify oneself properly, manifest abuse of power. |
| Disproportionate fees | Billing exceeding the government-regulated tariff, unjustified charges, fees disproportionate to the work actually performed (sec. 32-33 of the Code of ethics). |
| Negligence or conflict of interest | Failure of diligence causing harm to the client, lack of impartiality, breach of the duty to inform the parties, unauthorized disclosure of personal information. |
An investigation request to the Office of the Syndic aims to trigger a disciplinary process to protect the public. The Disciplinary Council cannot award you compensation or set aside a seizure — it can only sanction the bailiff at fault.
To contest the amount of a bailiff’s fee invoice, there is a separate procedure: the fee conciliation of the CHJQ. You have 45 days after receiving the account to make the request. This service is free and runs in parallel to a complaint to the syndic.
To contest the legal validity of a seizure or a judicial procedure, the appropriate recourse is to apply to the court that rendered the judgment, not to the syndic. A lawyer can advise you on these recourses.
The guide in 3 simple steps
Step 1 — Gather and organize your facts
Before asking anything from the AI, put your facts in order. Open a document and write a simple chronological summary. Be brief, direct and factual. Include the essential elements:
• The full name of the bailiff concerned and their permit number (available in the CHJQ directory).
• The name of the bailiff’s firm and its professional address.
• The key dates of the events complained of — service, seizure, eviction, receipt of invoice.
• A concrete description of the actions or inactions — e.g., « refused to present their member card », « shouted and threatened in the presence of my children », « billed $850 when the prescribed tariff is $125 ».
• The evidence you have: minutes of service, detailed invoices, recordings, statements from people present, photos, screenshots.
You can verify a bailiff’s registration in the official CHJQ directory. If the person is not listed, they are not a recognized bailiff — this is in itself grounds for a criminal complaint for unlawful practice.
Step 2 — Ask Claude to draft your investigation request
Open Claude — or Gemini or ChatGPT — and paste your facts with this prompt:
« I want to draft an investigation request to the Office of the Syndic of the Chambre des huissiers de justice du Québec (CHJQ), against bailiff [Name, permit number, firm]. Here are my facts: [paste your chronological summary]. Draft a factual, clear and professional investigation request. Identify the obligations of the Code of ethics of bailiffs that appear to have been violated (compliance with the rules of service of the Code of Civil Procedure, billing in accordance with the regulated tariff, diligence, integrity, duty not to cause harm). The document must be respectful and ready to be sent by email. »
The AI will draft a structured initial version that connects your facts to the bailiff’s professional obligations — without you needing to master the law. Read carefully and verify that all facts are accurate before moving on to the next step.
Step 3 — Send your request to the Office of the Syndic
The Chambre des huissiers offers two official channels to submit an investigation request: email to the Syndic (the fastest channel), or the official PDF form to download, fill out and send by email or by mail with supporting documents.
The service is entirely free. The Syndic will send you an acknowledgment of receipt. The investigation is strictly confidential and the order undertakes to comply with the deadlines set by the Professional Code. Keep your file number — that is what you will need to use in all subsequent communications.
Possible decisions after the syndic’s investigation
Once the investigation is complete, the Syndic informs you in writing of their decision:
Decision to file a complaint before the Disciplinary Council · OR decision not to file a complaint (closure of the file).
If the Syndic decides to file a complaint, the Disciplinary Council of the Chambre des huissiers will hear the case. It is composed of three persons: a chair appointed by the Government (a lawyer) and two bailiffs. If the bailiff is found guilty, several sanctions can be imposed: reprimand, temporary or permanent striking off the roll, restriction or suspension of the right to practise, or fine. The bailiff can appeal the decision before the Professions Tribunal.
If the Syndic decides not to file a complaint, you have the right to request the opinion of the Review Committee. Your request must be submitted in writing within 30 days of receiving the decision.
You have 30 days to request a review of a refusal. Do not let this deadline pass.
As a last resort, a citizen can also file a private complaint themselves directly with the Disciplinary Council, without going through the syndic. This procedure is more complex: you then become responsible for preparing the file, presenting the evidence and demonstrating the ethical breaches. It is strongly recommended to consult a lawyer for this option.
What AI does — and what it does not do
AI helps you organize your facts and draft a clear and professional document. It does not give you legal advice and does not replace a legal professional.
If your claim is to obtain damages for harm suffered, an ethics complaint is not the right recourse. You will have to bring a civil action before the courts. A lawyer can guide you — or, if you are eligible, legal aid can cover your fees.
To verify whether a seizure was legally valid, or to understand your rights when dealing with a bailiff, the Centres de justice de proximité offer free legal information. You can also consult our guide Bailiffs in Quebec: all you need to know.
Your complaint deserves to be heard
Bailiffs hold considerable powers — seizing property, serving documents, executing judgments, evicting tenants. These powers come with strict ethical duties. When a bailiff fails in these duties, the Office of the Syndic of the CHJQ exists to receive your complaint, free of charge. Organize your facts, draft your investigation request with the help of AI, and submit it. The rest is up to the Syndic.
